General General 1. Brian's Model Cars (BMC) consists of many different features combined into one website. Most of the Terms of Service (TOS) will deal with those specific features however a few general issues need to be addressed first. 2. First and foremost, your use of BMC constitutes your agreement to abide by and be bound by the following Terms of Service. If you do not agree with any of these terms please leave BMC now. 3. You must be polite to each other and treat each other with respect. We have members from all over the world, some of whom do not speak English as their native language, and we must endeavor to understand them and welcome them. Not ridicule and scorn them. The same goes for our members who are as young as thirteen years of age and non-members who may be any age at all. 4. Even though we all try to get along misunderstandings, disagreements, and complaints are bound to happen occasionally. When they get beyond reasonable you shall resort to resolving them privately. This is especially true if you disagree with something one of our administrators or moderators has done. If you cannot work things out between yourselves please contact an Administrator or Moderator and every effort will be made to help resolve the issue. 5. Using SiteMail or an e-mail link to send BMC's members Unsolicited Commercial E-Mail (UCE) aka spam will result in immediate termination of your account. You will also be reported to your ISP and several Reverse DNS Blacklists. 6. To allow for future growth and changes BMC reserves the right to modify these Terms of Service at any time. A notice will always be posted in the forums when a significant change is made to the Terms of Service. Members 1. To keep BMC in compliance with the Childrens Online Privacy Protection Act of 2000 (see COPPA) you must certify that you are 13 years of age or older in order to register with BMC. Individuals under 13 years of age would need a full release form from their parents and BMC is not prepared to accept the risks and challenges of such situations. Therefore you must be at least 13 years of age to become a member. 2. If you do not login for a period of one year your account becomes subject to deletion. If this happens you are always welcome to sign-up again if you want to become an active member again. 3. It shall be the responsibility of each member to keep their contact information up to date. 4. Any model, review, tutorial or message submitted by a member is granted a shared copyright for use on BMC in perpetuity. 5. All trademarks and copyrights posted in any gallery, review, tutorial or message are owned by their respective owners. 6. All comments posted in any gallery, review, tutorial or message are owned by the member. 7. Profanity, as defined at the time by the Founders, Administrators or Moderators, is not permitted anywhere in public on BMC. 8. You agree to receive e-mail from various site personnel in the course of doing their jobs at BMC. This does not mean you have to receive e-mail from all members of BMC. That's up to you to decide. 9. BMC reserves the right to delete your membership at any time. BMC also reserves the right to take all reasonable measures to prevent you from signing-up again, or in some cases, from even viewing the website. Reviews 1. Please keep in mind that other members and guests might be depending upon the reviews of a kit to decide whether or not to buy the kit. Please do your best to be thorough, accurate, and above all else, objective. 2. If you start a new kit review you shall upload a photograph of the model's box-top. This is usually the best way to document the model that's being reviewed. 3. Alex Kustov, a respected member of the modeling community, a published author, and a long-time member of the BMC community is our Reviews Administrator. 4. The Reviews Administrator has the final say on all reviews that are posted. All reviews are queued for approval and you will be notified via e-mail once your queued review has been processed. 5. While all reviews are subject to editing or deletion due to inappropriate language or poor spelling, the overall opinion of the review itself shall never be changed. 6. A review may be merged with an existing review, or deleted if it's posted in an inappropriate spot, or is a duplicate of an existing review. 7. If any single review is sufficiently inconsistent with the consensus of the kit's review as a whole the single review may be deleted. 8. There are software-enforced limits on the total number of reviews you can submit in any given period. Please see the FAQ for more details about these limits. Galleries 1. Members in good standing will automatically receive a Starter Gallery after one month. Starter galleries function exactly the same as regular galleries with one exception. They are limited to five models with up to five photographs per model at any one time. Regular galleries are currently unlimited. 2. If you have been a member of BMC for at least three months, have demonstrated an ability to complete WIP and Reviews, and take good photographs, you are invited to apply for Galleries access. If you meet the requirements a link to the application will be visible on the My Account page. Just because you can apply doesn't mean you'll be approved. Our Galleries Administrator will scrutinize your contributions to BMC and make a decision whether or not to approve you. The process usually takes three days to a week depending on how busy things are. 3. To maintain galleries access you must continue to demonstrate a commitment to being an active member of BMC. Starter Galleries are generally not subject to this term. 4. Do not post incomplete or in-progress models. The galleries are for 100% completed models only. Incomplete models will be deleted when found and a sufficient number of these issues may result in a reduction or loss of galleries access. 5. You may not link directly to your photos in the galleries. We have software that returns a dummy image when you do that. Please see the FAQ for information on how to properly link to all your galleries as well as just one gallery. 6. There are software-enforced limits on the total number of models you can add in any given period. Please see the FAQ for more details about these limits. 7. Our Galleries Administrator is long-time member Gator. He has the final word on galleries access for all members. Forums 1. All forums have specific topics that are considered appropriate for discussion. There is a Charter for each forum and that Charter defines what is and is not permissible in each forum. A forum Charter shall always supersede the Terms of Service. 2. Administrators and Moderators have an obligation to look for Terms of Service and Charter offenses and deal with them when they see them. This includes editing messages to remove questionable material or to try and salvage threads that might otherwise have to be locked and/or completely deleted. They also have the right to move, merge, split, lock and delete messages as they see fit. 3. Links to, photos of, or comments about adult content, near adult content (including model and swimsuit sites), or messages describing any offensive, obscene or illegal content will be permanently removed as soon as reasonably possible. 4. Posting self-promotional messages, especially with links to commercial or personal websites by the site's owners or representatives are not allowed in any forum and will be deleted. Announcements about non-commercialized shows are almost always welcome. 5. Links to other model car websites that have a forum are not permitted in your messages unless the site is listed in our Links section. Links within BMC are always acceptable. Although moderators try to remove links with inappropriate content, BMC is not responsible for the content of linked sites. 6. Attachments that include copyrighted material or messages that make more than "fair use" of copyrighted material will be deleted. BMC retains the right to decide what constitutes fair use. All legal fees that might arise as a result of breach of fair use shall be paid by the member who allegedly committed the infraction. 7. Posts should include proper sentence structure out of consideration for our many members who do not speak English as their native language. That means using capitalization, reasonable punctuation and no excessive abbreviations. Posts should be structured as if you were writing a letter to someone instead of sending a text message. The goal is not to have perfectly written messages, rather to encourage a writing style accessible to all members, including those who don't speak English well, or who have to use translation services. 8. Reasonable reviews of retailers and other vendors, both positive and negative, are always welcome. Such reviews, and the ensuing discussion, usually benefits all of us. However, claims of action, flames, libel, and calls to action against any entity or individual shall be removed. All legal fees that might arise as a result of alleged or proven libelous statements shall be paid by the member who allegedly committed the infraction.
